These Terms of Use govern access to and use of the Delvera Development website, its forms, account features, newsletters, and related online services. In these Terms, "Delvera Development," "we," "us," and "our" mean the Delvera Development website and the Connecticut limited liability company or other U.S. operating entity that owns or operates it, together with its applicable affiliates. By using the Site, you agree to these Terms.

1. Permitted Use

You may use the Site only for lawful purposes and in accordance with these Terms. You may not use the Site to interfere with its operation, attempt unauthorized access, scrape or harvest content at scale, transmit malware, submit misleading or unlawful information, or violate the rights of Delvera Development or any other person.

Home availability, pricing, square footage, features, finishes, community information, delivery timelines, renderings, and future development plans may change without notice. Submission of a form, inquiry, or interest request does not reserve a home, create a contractor, broker, fiduciary, or agency relationship, or bind us to enter into any transaction.

Any investor-related content on the Site is for preliminary informational discussion only. To the fullest extent permitted by applicable law, Delvera Development and its members, managers, officers, employees, contractors, agents, affiliates, successors, and assigns will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages arising out of or related to the Site or these Terms, even if advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our aggregate liability arising out of or relating to the Site and these Terms will not exceed the greater of $100 or the amount, if any, you paid directly to us for use of the Site during the 12 months before the event giving rise to the claim. This limitation does not alter any separate written agreement you sign directly with us for construction, acquisition, investment, consulting, or other services.

12. Indemnification

You agree to defend, indemnify, and hold harmless Delvera Development and its members, managers, officers, employees, contractors, agents, affiliates, successors, and assigns from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your misuse of the Site, your submissions, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Connecticut and applicable U.S. federal law, without regard to conflict of law rules. Unless a separate written agreement states otherwise, any dispute arising out of or relating to the Site or these Terms must be brought exclusively in the state or federal courts located in Connecticut, and you consent to those courts' personal jurisdiction and venue.

14. Changes, Suspension, and Termination

We may update, suspend, discontinue, or restrict all or part of the Site at any time, with or without notice. We may revise these Terms from time to time by posting an updated version on this page. Your continued use of the Site after the revised Terms become effective constitutes acceptance of the updated Terms.
